Council receives notice of vegetation works for Phillip Dr development

Residents may have noticed equipment set up and works take place at a development site on Phillip Drive in South West Rocks over the weekend.
Kempsey Shire Council received notice that works would be carried out on Lot 2 DP1091323 on the weekend of 5 and 6 November 2022.
The developer notified Council that they planned to move the fencing back 12 metres from the front boundary, which they advise will comply with the state exemptions through Clauses 2.33 and 2.34 of State Environmental Planning Policies (Exempt & Complying Development Codes) 2008.
The developer outlined that moving the fence would involve vegetation trimming and removal and expressed the intent to continue routine bushfire management on the site by slashing grassland areas. The developer engaged an ecologist, who confirmed these activities are exempt per Chapter B10 of Kempsey Development Control Plan 2013.
As long as the developer stays within the exemptions, Council cannot require a development application or take any compliance action.
