(Draft Amendment No 9) Various Land Use Table Amendments

Seeking to amend the Kempsey Local Environmental Plan 2013 to allow ‘information and education facilities’ and ‘restaurant and cafes’ as uses that are permitted with consent in the RU1 Primary Production, RU2 Rural Landscape and RU4 Primary Production Small Lots, as well as ‘tourist and visitor accommodation’ in RU1 Primary Production, RU2 Rural Landscape, RU4 Primary Production Small Lots and R5 Large Lot Residential zones

Council has prepared a Planning Proposal to amend the Kempsey Local Environmental Plan (KLEP) 2013 (Draft Amendment No 9). The Planning Proposal aims to:

  • Make ‘information and education facilities’ permissible with Development Consent in the RU1 Primary Production, RU2 Rural Landscape and RU4 Primary Production Small Lots zones. At present ‘information and education facilities’ are prohibited in these zones;
  • Make ‘restaurant and cafes’ permissible with Development Consent in the RU1 Primary Production, RU2 Rural Landscape and RU4 Primary Production Small Lots zones. At present ‘restaurant and cafes’ are prohibited in these zones; and
  • Make ‘tourist and visitor accommodation’ permissible with Development Consent in the RU1 Primary Production, RU2 Rural Landscape, RU4 Primary Production Small Lots and R5 Large Lot Residential zones. At present ‘tourist and visitor accommodation’ is prohibited in these zones.

The Planning Proposal will be on exhibition from Tuesday 14 June 2016 until Wednesday 13 July 2016. The Planning Proposal is available for viewing and downloading on Council’s website: www.kempsey.nsw.gov.au/public-exhibition . Hard copies of the Planning Proposal will also be available at Customer Services, Kempsey Shire Council at 22 Tozer Street West Kempsey between 8:30am and 4:30pm, and in the Kempsey Library, during opening hours. Any interested person may inspect the Planning Proposal at the above location during the exhibition period.

Submission to the Planning Proposal should be addressed to the General Manager and may be made electronically to ksc@kempsey.nsw.gov.au or in hard copy to PO Box 3078 West Kempsey, 2440. All submission should be received before 4:30 pm on 13 July 2016. Please note that any submission received by Council may be made publicly available.

A person who makes a written submission to a planning application is required to disclose all reportable political donations and gifts (if any) made by the person making the submission or any associate of that person within the period commencing two years before the submission is made and ending when the application is determined. A disclosure statement form and further details can be obtained from Council’s website www.kempsey.nsw.gov.au

Please note that Section 2.2.1 on page 8 of the Planning Proposal identifies that further changes are recommended to the Kempsey Local Environmental Plan 2013 and/or the Kempsey Development Control Plan 2013 prior to the public exhibition of this planning proposal. This relates to additional planning controls for ‘restaurant and cafes’ uses only. However these further amendments will now occur at a later stage and will be in the form of a Development Control Plan (DCP). Any future draft DCP would be subject to further community consultation. Matters raised in submissions will be considered in the further development of these controls.
